  • We collect a variety of information (including personal information) from You and also from third parties about You, including: (a) customer information (such as name, address, email address and date of birth), some details about Your fitness and fitness goals, purchase information, and, if You are a Minor, details of Your parent/guardian consents; (b) payment confirmation details; (c) web, app, device and browser details and use data; and (d) other information as described in the Policy below.
  • You consent to the collection, use, storage, and disclosure of the information We collect for the purposes outlined in this Policy and in Our Terms of Service, including: (a) to provide and maintain Our Service, including to monitor the usage of Our Service; (b) to enable You to access and use Our Service (including Minors with parent/guardian consent); (c) to administer any Subscription, In-app Purchase or other orders or purchases made through the Service and otherwise provide products and/or services to You; (d) to provide marketing (including but not limited to direct marketing and any advertising on websites and social media) and other communications to You (subject to any marketing preferences You have provided to Us); (e) to advertise on third party websites and to provide You with re-targeted advertising after You have visited or used Our Service (and provide other behavioural remarketing or advertising); (f) to assist in identifying ways in which We can provide You and other customers with a better Service, or enhance the Service; and (g) any other purpose set out in this Policy.
  • You may opt-out of receiving marketing materials from Us by contacting Us using the Contact Us information below in section 18 or by using the opt-out facilities provided in the applicable marketing communications (e.g. an unsubscribe link) or in the App or Your Account profile.
  • We and/or Our third party service providers may also use cookies or other similar tracking technologies on Our Service, the Websites or the App that help Us track Your usage of the Service and remember Your preferences.
  • You also consent to Us transferring or disclosing Your personal information to third party service providers as described in this Policy, including service providers who hold that data in their home countries or their regional data centre locations (which may include Australia, the USA, Canada and/or EU and EEA countries), and acknowledge that We are not required to ensure that these recipients handle that personal information in compliance with Australian Privacy Laws.

If We are not provided with the information requested or the information provided is incorrect or incomplete, We may be unable to provide the Service or parts of it to You.

Capitalised or defined terms used in this Policy have the meanings given in the body of this Policy or in section 17 below (unless the context requires otherwise).

1. Introduction

1.1 TrainLike Holdings Pty Limited ACN 670 520 546 and each of its Affiliates is committed to respecting Your privacy.

1.2 This Privacy Policy sets out how We collect, use, store and disclose Your personal information.

1.3 By providing personal information to Us, or downloading or using the App, creating an Account, purchasing a Subscription, making an In-app Purchase, submitting an Order, using or accessing the Service or any Service (including visiting, accessing or using any Website) or otherwise indicating Your acceptance of this Policy, You consent to Our collection, use, disclosure and handling of Your personal information in accordance with this Privacy Policy and any other arrangements that apply between You and any of Us from time to time.

1.4 Personal information includes information or an opinion about an individual that is reasonably identifiable. For example, this may include Your name, age, gender, date of birth, postcode and contact details.

1.5 This Policy applies to all visitors to and users of the Service, any Website or the App, including without limitation You, users who are browsers, customers, merchants, vendors, and/or contributors of content and any person that places an order for products and/or services or purchases products and/or services on or through the Service, any Website or the App.

1.6 We offer the Service, each Website and the App, including all information, tools and services available from or through any Website or the App to You, conditional upon Your acceptance of all terms, conditions, policies and other documents set out or referenced in this Policy.

1.7 Please read this Policy carefully before accessing or using the Service or any Service.

2. Changes to this Policy

2.1 We may change Our Privacy Policy from time to time by posting the changes or an updated version on the App and the applicable Websites. We encourage You to check the App and the applicable Websites periodically to ensure that You are aware of Our current Privacy Policy.

2.2 Any updates of this Policy will apply to any personal information and any other information We collect and/or hold about You. It is Your responsibility to check Our Privacy Policy periodically for changes and before You use or access the App or any Website.

3. What personal information do we collect?

3.1 We may collect the following types of personal information:

  1. name;
  2. telephone or mobile number and other contact details;
  3. mailing or street address;
  4. email address;
  5. gender;
  6. age and/or date of birth;
  7. any username or password You use for access to Your Account and the App;
  8. the Exercise Category You are interested in and some basic fitness-related information about You (such as Your fitness or experience level, training focus areas and training style, and training goals);
  9. Your Workout and Exercise history (such as logged exercises, progress tracking and activity logs);
  10. Your marketing preferences;
  11. if You are a Minor, details of the consent from Your parent/guardian to You using the Service and any evidence You provide to confirm that parent/guardian consent (“Parental Information”);
  12. Usage Data related to Your use of the Service, such as:
    1. Device IP address, Device ID, Device type, other unique Device identifiers, browser type, browser version, operating system, geo-location information, computer and connection information, statistics on page views (such as the pages of Our Service that You visit, the time and date of Your visit, the time spent on those pages, etc), traffic to and from the Websites, ad data, standard web log information and other diagnostic data;
    2. information that Your browser sends whenever You visit Our Service or when You access the Service by or through a mobile device; and
    3. information collected from Cookies, pixels, tags or other similar tracking technologies, to the extent it identifies You;
  13. details of the products and services We have provided to You or that You have enquired about (including when You download the App, create an Account, purchase a Subscription, make an In-app Purchase or submit an Order), including payment confirmation details for any payment made in relation to those products, services or transactions, and any additional information necessary to deliver those products and services and respond to Your enquiries;
  14. any additional information relating to You that You provide to Us through any Website or the App or that We collect through Your use of any Website or the App or any other Service online presence or through other websites or accounts from which You permit Us to collect information;
  15. information You provide to Us through customer surveys, competitions and promotions; or
  16. any other personal information that may be required in order to facilitate Your dealings with Us.

3.2 We do not collect credit card (or other payment card) information or other payment related information as payments are securely handled through Our payment gateway provider and/or the applicable App Store but We do receive and collect from the payment gateway provider or applicable App Store payment confirmation details for any payment made.

3.3 If We are not provided with this information or the information provided is incorrect or incomplete, We may be unable to provide the Service or parts of it to You.

4. How do we collect personal information?

4.1 We may collect the personal information outlined above either directly from You, or from third parties.

4.2 We may collect this information when You:

  1. visit, access or use any Website, create an Account, download the App, purchase a Subscription, make an In-app Purchase, submit an Order, otherwise access or use the Service or any Service, or make an enquiry about any of those things;
  2. register or set up Your profile when You download the App;
  3. make a payment to Us through Our payment gateway provider or the applicable App Store or purchase any of Our products or services;
  4. communicate with Us in any way, including through correspondence, chats, email, or when You share information with Us from other social applications, services or websites;
  5. interact with Us in any way including via social media, completing a customer survey, entering a competition or participating in a promotion;
  6. interact with Our Websites, Service, content or advertising; or
  7. invest in Our business or enquire as to a potential investment in or purchase of Our business.

4.3 We may also collect personal information and other information about You from various third parties such as from Our payment gateway providers (such as the App Stores or Stripe) and Our third party service providers.

4.4 In addition, if You are a Minor, We may collect the personal information outlined above either directly from You or from Your parent/guardian and, if You are a parent/guardian nominated by a Minor, We may collect the personal information outlined above from Your or from that Minor.

4.5 Usage Data is collected automatically when using the Service (by Us or Our third party service providers). Usage Data may be uploaded to Our servers and/or Our third party service provider’s server or it may be stored on Your Device.

4.6 We may also use Cookies to enable Us to collect data that may include personal information. For example, where a Cookie is linked to Your Account, it may be considered personal information. See section 9 below for more details on Our use of Cookies. We will handle any personal information collected by Cookies in the same way that We handle all other personal information as described in this Privacy Policy.

4.7 In addition, when You apply for a job or position with Us We may collect certain information from You (including Your name, contact details, working history and relevant records checks), from any recruitment consultant, Your previous employers and others who may be able to provide information to Us to assist in Our decision of whether or not to make You an offer of employment or engage You under a contract. This Privacy Policy does not apply to acts and practices in relation to employee records of Our current and former employees, which are exempt from the Privacy Act.

5. Why do we collect, use and disclose personal information?

5.1 We may collect, hold, use and disclose Your personal information for the following purposes:

  1. to provide and maintain Our Service, including to monitor the usage of Our Service;
  2. to enable You to access and use Our Service, the Websites and the App (including to enable Minors to access and use Our Service, the Websites and the App when consent is provided by a parent/guardian);
  3. to improve and customise Our Service and the App experience based on Users’ preferences and goals and to provide features of Our Service;
  4. to monitor and analyse the use of Our Service, and to operate, protect, improve and optimise Our Service, the Websites and the App, Our business and Our Users’ experience, such as to perform analytics, conduct research, develop customer insights and for advertising and marketing;
  5. to manage Your Account, to manage Your registration as a User of the Service, to provide You with access to different functionalities of the Service that are available to You as a registered User;
  6. to allow You to visit, access or use any Website, create an Account, download the App, purchase a Subscription, make an In-app Purchase, submit an Order, otherwise access or use the Service or any Service, or make an enquiry about any of those things;
  7. to process any Subscription purchased by You, to deliver any In-app Purchase or Order submitted and paid for by You, to deliver any other products, items or services You have purchased from Us, to provide You with any other access to or use of the Service or any Service, and to perform any other contractual obligation We have to You;
  8. to confirm Your payment of any amount to Us;
  9. to contact You (including by push notifications) and to send You informative communications related to the Service functionalities, products or contracted services, including service, support and administrative messages, reminders, technical notices, updates, security alerts and information requested by You;
  10. to send You marketing and promotional messages and other information that may be of interest to You, including information sent by, or on behalf of, Our business partners that We think You may find interesting, unless You have opted not to receive such information;
  11. to send You news, special offers and general information about other goods, services and events which We offer that are similar to those that You have already purchased or enquired about, unless You have opted not to receive such information;
  12. to advertise on third party websites and to provide You with re-targeted advertising, and/or use re-marketing services to provide You with re-targeted advertising, on third party websites after You have visited or used Our Service (also known as behavioural remarketing or advertising);
  13. to attend to and manage Your requests to Us;
  14. to allow You to share personal information or otherwise interact in the public areas of Our Service, or load User Content on the Service, or interact with other Users through the Service or a Third-Party Social Media Service;
  15. to administer rewards, surveys, contests, or other promotional activities or events sponsored or managed by Us or Our business partners;
  16. if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency), to comply with Our legal obligations, to protect and defend Our rights or property, to prevent or investigate possible wrongdoing in connection with the Service, to protect the personal safety or rights or property of Users of the Service or the public or to lessen a serious threat to a person’s health or safety, or to protect Us against any legal liability;
  17. to resolve any disputes that We may have with any of Our Users, and enforce Our agreements with third parties;
  18. to resolve any complaint by any User about the way We have handled Your personal information or about Our businesses, the Service, the Websites or the App;
  19. any purpose in connection with any sale or potential sale (or any merger with any other business or entity) of the Company, any Affiliate or any TrainLike Group business, assets or liabilities, or any financing or potential financing of or for the TrainLike Group or its businesses; and
  20. to consider Your employment application.

5.2 We may also disclose Your personal information to a trusted third party who also holds other information about You. This third party may combine that information in order to enable it and Us to develop anonymised consumer insights so that We can better understand Your preferences and interests, personalise Your experience (including Your experience in the App) and enhance the products and services that You receive.

5.3 We may also use information about You (including prior purchases, the way You interact with Our Websites and demographic data) which has been de-identified to help Us deliver marketing communications to You and other customers and Users and to display advertisements that We believe are likely to be of interest to You and other customers and Users.

6. To whom do we disclose your personal information?

6.1 We may disclose personal information for the purposes described in this Privacy Policy to:

  1. Our employees, contractors and professional advisors;
  2. Our Affiliates;
  3. third party suppliers and service providers (including suppliers, providers and businesses who assist Us to (i) store Our data, (ii) operate Our Websites, the App and/or Our businesses, (iii) provide the Service and/or Our products and services to You, and/or (iv) provide You with marketing, advertising and re-marketing);
  4. third party payment gateway providers or payment systems operators (eg. Stripe or App Stores when receiving payments) if necessary to confirm payment (but usually We do not provide personal information to Our payment gateway providers as You provide that information to them directly);
  5. Our existing or potential agents and business partners;
  6. Our sponsors or promoters of any competition that We conduct via Our services;
  7. any purchaser or potential purchaser of (or any business or entity that will or may merge with) the Company, any Affiliate, any TrainLike Group business, assets or liabilities, or any financier or potential financier of or for the TrainLike Group, or anyone who is negotiating with Us in relation to such a transaction;
  8. specific third parties authorised by You to receive information held by Us; and/or
  9. other persons, including government agencies, regulatory bodies and law enforcement agencies, or as required, authorised or permitted by law. We may be required to disclose Your personal information if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

6.2 Unless otherwise stated in this Policy, We only provide third party suppliers and service providers with access to the personal information We hold about You in order for them to perform their tasks and/or services on Our behalf and where they are obligated not to disclose or use it for any other purpose.

6.3 When You share personal information or otherwise interact in the public areas of Our Service, or when You load User Content on the Service, or when You share Your Workout or Exercise experience with others, Your personal information may be viewed by other Users and may be publicly distributed outside the Service (such as on social media). If You interact with other Users through the Service or a Third-Party Social Media Service, Your contacts on the Third-Party Social Media Service may see Your name, profile, pictures and description of Your activity. Similarly, other Users may be able to view descriptions of Your activity, communicate with You and view Your profile.

6.4 In addition, if You are a Minor, We may disclose Your personal information to Your parent/guardian and, if You are a parent/guardian nominated by a Minor, We may disclose Your personal information to that Minor, for the purpose of enabling the Minor to access and use Our Service, the Websites and the App in accordance with the consent provided by the parent/guardian.

7. Disclosure of personal information outside Australia

7.1 We may hold and/or process Your personal information in Our database, which is hosted by AWS cloud infrastructure in the applicable AWS regional data centres (which may include Australia and/or the USA).

7.2 We may also disclose personal information to third party service providers who hold that information in their home countries or their regional data centre locations (which may include Australia, the USA, Canada and/or EU and EEA countries).

7.3 When You provide Your personal information to Us, You consent to the disclosure of Your information in and outside of Australia and acknowledge that We are not required to ensure that recipients outside of Australia handle that personal information in compliance with the Privacy Act.

7.4 We will, however, take reasonable steps to ensure that any recipient will deal with such personal information in a way that is consistent with the Australian Privacy Principles (such as by seeking to include an undertaking to that effect in Our contract with the recipient) but We cannot guarantee that any recipient will agree to do so or will comply with the Australian Privacy Principles.

8. Do we use your personal information for direct marketing?

8.1 Yes, We and/or Our carefully selected business partners may use Your personal information to send You direct marketing communications and information about Our Service, the Websites and the App or other products or services that We think You might be interested in. This may take the form of emails, SMS, mail or other forms of communication, in accordance with the Privacy Act and other Australian legislation (as applicable), and We may use third party marketing service providers to manage and send these communications to You.

8.2 You may opt-out of receiving any, or all, of these marketing materials from Us by contacting Us using the Contact Us information below in section 18 or by using the opt-out facilities provided in the applicable marketing communications (e.g. an unsubscribe link) or in the App or Your Account profile. You agree that if You unsubscribe from one category of marketing communications You may still continue to receive other categories of marketing communications, unless You opt out of all categories of marketing communications.

9. Cookies, Analytics and remarketing

9.1 Cookies

  1. We and/or Our third party service providers on our behalf may collect personal information about You (or the device You use to access Our Service) when You use and access Our Service, the Websites or the App, including Usage Data.
  2. While We do not use browsing information to identify You personally, We may record certain information about Your use of Our Service, the Websites or the App, such as which pages You visit, the time and date of Your visit and the IP address assigned to Your computer.
  3. We may also use Cookies or other similar tracking technologies on Our Service, the Websites or the App that help Us track Your usage of the Service and remember Your preferences. By using Our Service, You grant Us and/or Our third party service providers permission to place and store pixels, tags and Cookies on Your browser which may be used by Us to collect information about how You use Our Service.
  4. Cookies enable the entity that put the Cookie on Your device to recognise You across different websites, services, devices and/or browsing sessions. You can disable Cookies through Your internet browser but Our Service, the Websites or the App may not work as intended for You if You do so.

9.2 Analytics

  1. Google Analytics is a web analytics service offered by Google that tracks and reports website traffic including Our Websites. Firebase is another (Google owned) analytics provider that collects and provides Us with a range of Usage Data and related analytics services.
  2. When You visit or use Our Service, We and/or third party service providers (such as Google Analytics and Firebase) may place Cookies, tags and pixels on Your browser to enhance and manage Our Service and improve Our business and the Service.
  3. Google and Firebase use the information they collect to track and monitor the use of Our Service and other websites You visit and use after visiting Our Service. This information may be shared with Us and other Google services.
  4. We and/or third party service providers may use the information collected to optimise and place advertisements, including advertisements of third party vendors and remarketing advertisements on Our Websites and third party websites based on past visits to the Service, the Websites and/or the App.
  5. We may combine this information with similar information from Our Websites and the App to undertake data analytics and matching, to personalise Your experience of the Websites and/or the App and (where You have consented to receiving direct marketing) to offer products or provide services to You or send direct marketing to You.

9.3 Remarketing

  1. We may also use this information and other information to provide You with re-targeted advertising regarding Our Service, and/or use re-marketing services to provide You with re-targeted advertising, on third party websites after You have visited or used Our Service (also known as behavioural remarketing or advertising).
  2. We or Our third party service providers use Cookies to inform, optimise and serve ads based on Your past visits to Our Service. You can usually opt out of this re-targeted advertising, and/or customise the advertising provided to You, by using the facility within Your browser. 10. Payments

10.1 We may offer or provide products and/or services within or through the Service in return for payment. In that case, We may use third-party services for the payment gateway and processing (e.g. payment processors such as Stripe and/or an App Store).

10.2 We do not collect credit card (or other payment card) information or other payment related information as payments are securely handled through Our payment gateway provider and/or the applicable App Store but We do receive and collect from the payment gateway provider or applicable App Store payment confirmation details for any payment made.

10.3 When You make a payment for Our products or services, a Subscription or an In-App Purchase, through Our payment gateway provider or the applicable App Store, that payment gateway provider / App Store is the merchant of record for the purchase (meaning all payment processing, invoicing, and refunds (if applicable) are handled by them) and You are engaging with that payment gateway provider / App Store as a customer of that payment gateway provider / App Store. Accordingly, the payment gateway provider / App Store terms of service apply to Your dealings with them and their dealings with Your personal information are governed by their privacy policy, as described below:

  1. For purchases through Our Websites (not through an App Store), You will need to provide Your payment card and other payment details directly to Our third-party payment gateway provider whose use of Your personal information is governed by their privacy policy. For example, Stripe’s Privacy Policy can be viewed at https://stripe.com/Us/privacy
  2. For purchases through an App Store or for In-app Purchases, You will need to provide Your payment card and other payment details directly to the applicable App Store whose use of Your personal information is governed by their privacy policy. For example, the Apple Store Privacy Policy can be viewed at https://www.apple.com/legal/privacy/

11. A word on Minors

11.1 We do not permit those under 13 years of age to use the Service. We do not knowingly collect personal information from anyone under the age of 13. If You are a parent or guardian and You are aware that Your child has provided Us with personal information, please contact Us. If We become aware that We have collected personal information from anyone under the age of 13 without parent or guardian consent, We take steps to remove that information from Our servers.

11.2 We do however seek to provide a process under which anyone who is 13-17 years of age (referred to herein as Minors) may access the Service, or parts of the Service, with parent/guardian consent. See Our treatment of Minors and Parental Information set out in this Policy for further details of how a Minor’s and their parent/guardian’s personal information is collected, used, disclosed and stored.

11.3 If We need to rely on consent as a legal basis for processing Your personal information or Your country of residence requires consent from a parent/guardian, We may require consent from Your parent/guardian before We collect and use that information.

12. Retention of personal information

12.1 We will retain and use Your personal information as long as it may be required for the purposes set out in this Privacy Policy (including to comply with Our legal obligations (e.g., tax, regulatory, or law enforcement requirements) and to allow You to re-subscribe to the Service or the App or restore Your Account within a reasonable time after You have unsubscribed or cancelled Your Account.

12.2 We may also retain Usage Data and de-identified information indefinitely for internal analytics, service improvements, and research purposes, provided that the data and information does not identify individual users.

13. Security

13.1 The security of Your personal information is important to Us, but remember that no method of transmission over the internet, or method of electronic storage is 100% secure. While We strive to use commercially acceptable means to protect Your personal information, We cannot guarantee its security.

13.2 We may hold Your personal information in either electronic or hard copy form. Hard copy form is held at Our secure premises at New South Wales, Australia. All personal information in electronic form is stored in Our database, which is hosted securely on AWS cloud infrastructure in the applicable AWS regional data centres (which may include Australia and/or the USA).

13.3 We take reasonable steps to protect Your personal information from misuse, interference and loss, as well as unauthorised access, modification or disclosure and We use a number of physical, administrative, personnel and technical measures to protect Your personal information. For example:

  1. We rely on AWS cloud security measures to secure Our database on AWS cloud infrastructure; and
  2. We implement strict access control measures for Our database to protect user data against unauthorised access.

However, as noted above, We cannot guarantee the security of Your personal information.

14. Links

14.1 Our Service may contain links to websites, social media pages or feeds, services or resources that are not owned or controlled by Us (“Third Party Sites”). These links are provided for Your convenience only and may not remain current or be maintained. Unless expressly stated otherwise, We are not responsible for the privacy practices of, or any content on, those Third Party Sites, and have no control over or rights in those Third Party Sites. The privacy policies that apply to those Third Party Sites may differ substantially from Our Privacy Policy, so We encourage individuals to read them before using those sites.

14.2 Where this Policy states that the privacy policies or privacy terms of a third party or third party business apply to the personal information collected by them, those third party privacy policies or terms may be substantially different to Our Privacy Policy. We encourage You to read those third party privacy policies or terms before using those third party services and Our Service. Refer to the relevant website of the third party or third party business for more information on how these parties store and use Your personal information.

15. Accessing or correcting your personal information

15.1 You can access the personal information We hold about You by contacting Us using the Contact Us information below in section 18. Sometimes, We may not be able to provide You with access to all of Your personal information and, where this is the case, We will tell You why. We may also need to verify Your identity when You request Your personal information.

15.2 If You think that any personal information We hold about You is inaccurate, please contact Us (section 18 below) and We will take reasonable steps to ensure that it is corrected.

16. Making a complaint

16.1 If You think We have breached the Privacy Act, or You wish to make a complaint about the way We have handled Your personal information, You can contact Us using the Contact Us information below in section 18. Please include Your name, email address and/or telephone number and clearly describe Your complaint. We will acknowledge Your complaint and respond to You regarding Your complaint within a reasonable period of time. If You think that We have failed to resolve the complaint satisfactorily, We will provide You with information about the further steps You can take.

17. Definitions and Interpretation

17.1 Definitions

For the purposes of this Policy:

Account means a unique digital account created by Us for You to access the Service or parts of the Service.

Affiliate in respect of a party means an entity that controls, is controlled by or is under common control with that party, where “control” of an entity means the ability to control, directly or indirectly, (a) the composition of the board of directors (or other governing body) of that entity, (b) more than half of the voting rights of voting securities of that entity, or (c) the management of the affairs of that entity.

the App means Our ‘TrainLike’ mobile application, downloaded by You on any electronic device, as may be branded and adapted for each Category, and the exercise Categories and databases to which the App provides access (the App is also referred to by reference to the exercise Category or database to which access is or has been provided through the App, for example, the App is referred to as the ‘TrainLike a Ballerina App’ in connection with the Ballerina/Ballet exercise Category or database offered through the App).

App Store means the digital distribution service operated and developed by Apple Inc. (Apple App Store) or Google Inc. (Google Play Store) from which the App has been or can be downloaded.

Australian Privacy Principles means the Australian Privacy Principles under the Privacy Act 1988 (Cth).

Category refers to the discrete Exercise, Workout and Program database Category of the relevant Service business of the Company’s Affiliates (such as ‘TrainLike a Ballerina’ and ‘TrainLike an Athlete’ etc.). For example, the Category for the ‘TrainLike a Ballerina’ Service business is training like a Ballerina.

Company means TrainLike Holdings Pty Limited ACN 670 520 546 incorporated in Australia.

Cookies are small files that are placed on Your computer, mobile device or any other device by a website, containing the details of Your browsing history on that website and other information.

Device means any device that can access the Service such as a computer, a mobile phone or a digital tablet.

Exercise refers to a single discrete exercise, from the Exercise library, in the relevant Category, made available through the App. For example, an exercise from the ‘TrainLike a Ballerina’ Exercise library.

Exercise library refers to the library of Exercises, in the relevant Category, made available through the App. For example, the ‘TrainLike a Ballerina’ Category Exercise library made available through the ‘TrainLike a Ballerina’ branded App.

Goods refer to the items offered for sale on a Website (other than a Subscription).

In-app Purchase refers to the purchase of a product, item, service or Subscription made through the App (which shall be subject to the Terms of Service as well as the App Store’s own terms and conditions).

Minor means a natural person who is 13 to 17 years of age.

Order mean a request by You to purchase Goods from Us.

Privacy Act means the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

Privacy Policy or this Policy means this Privacy Policy as made available and as updated from time to time on the App and Our Websites.

Program refers to a selection of Workouts, in the relevant Category, where the Workouts have a common theme or objective. For example, a Program from the ‘TrainLike a Ballerina’ Category aimed at improving a particular pirouette.

Service refers to (1) Our Websites; (2) any Account We provide for Your use of the Service; (3) the App (as may be branded and adapted for the Category or Exercise library database to which access is or has been provided through the App); (4) the Exercises, Exercise library, Workouts and Programs in each Category as made available through the App; (5) any Subscriptions, In-app Purchases, facility for Orders or submitting Orders and/or purchases of Goods; and (6) any other goods, services, content and/or features made available by Us through the Websites or the App, in each case as such services may be amended by Us from time to time.

Subscription refers to a subscription to access and use certain parts of the App for the applicable Subscription Period (as offered by Us and described in the Terms of Service and/or in the App from time to time).

Terms of Service means the terms of service issued by the Company from time to time, together with any documents they expressly incorporate by reference, as each may be amended from time to time, that govern any and all use of or access to the Service or any Service.

Third-party Social Media Service means any online digital platform service or content (including data, information, products or services) provided by a third party that may be displayed, included or made available by the Service or that may allow login to the App using that platform’s login process.

TrainLike Group means the Company and its Affiliates from time to time.

Usage Data refers to information that is collected automatically when You use the Service. This information is generated by User interactions with the Service or by the Service infrastructure itself. For example, Usage Data may include details such as:

  1. the duration of a page or screen visit;
  2. App usage statistics (e.g., features accessed, workout sessions completed);
  3. device and browser information;
  4. IP address and approximate location (if applicable); and
  5. time and date of access.

Usage Data may also include other details as described in section 3.1(l) in this Policy.

User means any person, visitor or user accessing or using the Service or any part of it, including You.

User Content means any material or content (such as text, images, or other information) that is posted, uploaded or otherwise made available by You on or through the Service (including by way of You posting or uploading a link to that content on or through the Service) which is accessible by Us and/or other users, regardless of the form of that material or content.

  2. each Affiliate of the Company that offers or provides any Service, in respect only of that Service the Affiliate offers/provides.

Website means each of Our websites from time to time applicable to a TrainLike business (including https://trainlike.app) and any of Our other websites to which the Terms of Service are posted (as each such website url may be updated from time to time) and Websites means all or any one or more of them.

Workout refers to a selection of Exercises, from the Exercise library, in the relevant Category, where the Exercises have a common theme or objective. For example, a Workout from the ‘TrainLike a Ballerina’ Exercise library.

You or you means the natural person accessing or using the Service or any Service (and Your or your has a corresponding meaning).

You can review the latest version of this Policy on the App or any Website. You agree that the version of this Policy available at https://trainlike.app/privacy-policy shall prevail in the case of any inconsistency with any other version of this Policy.

If this Policy is presented to You in a language other than English then they have been translated from the original English version (either by Us or by Your search engine or some other intermediary). If so, You agree that the original English text available at https://trainlike.app/privacy-policy shall prevail in the case of any inconsistency with any translated version.
